Constitutional Court Confirms the Business Community’s Position: Tax Policies Must Ensure Legal Certainty

The Economic Chamber of North Macedonia welcomes the Constitutional Court’s decision to annul the Law on Solidarity Tax, reaffirming the validity of the arguments consistently presented by the business community over the past period.

From the very beginning, the Chamber has consistently emphasized that this legal measure—particularly its retroactive application for the 2022 fiscal year—seriously undermines legal certainty and foreseeability within the business environment. The Constitutional Court’s ruling validates the stance that selective and retroactive taxation is not an appropriate economic regulatory mechanism and sends an important message about the need to uphold legal security, which is a key prerequisite for economic growth and attracting new investments.

As the largest business association in the country, the Chamber has taken an institutional approach through formal letters, legal arguments, and procedural mechanisms. The initiative was endorsed by the Management Board, Supervisory Board, Assembly of the Chamber, the Foreign Investors Council, and other business associations.

Moving forward, we expect that any future tax policy will undergo thorough analysis and be developed in consultation with the business community to prevent negative economic impacts. The Economic Chamber remains committed to a transparent dialogue with institutions to establish sustainable economic policies that will drive growth and development within the business sector.
